Services

Our services include:

  • Pre-mediation consultation — We explain the process, review the mediation contract and discuss fees. The parties then mutually decide whether or not they want to move forward with using mediation to resolve their dispute.
  • Facilitative mediation — We help the parties have the conversation…we don’t have it for them. It’s their discussion from start to finish and our role is to enable them to have it in a productive way.
  • Agreement drafting — We develop a written memorandum of understanding of what the parties have agreed to subject to acceptance, modification, or rejection by their attorney (if they have one).
  • Post mediation follow-up — If the parties ever have a future disagreement over the interpretation or operation of an agreement, we can help.

The process begins with you understanding how mediation works and determining whether or not it is right for you and the other party or parties involved. To help with this, we provide all potential clients with a no-pressure, 30-minute consultation on the mediation process at no cost.

Meetings

Consultation sessions as well as mediation meetings can be conducted either in-person or virtually (i.e., via Zoom). For in-person mediation meetings, the parties will be responsible for arranging a private meeting space and for all costs (mileage/time) associated with mediator travel.

Confidentiality 

All mediation sessions, certified mediation courses and mediator mentorships are conducted under the Commonwealth of Virginia’s “Standard of Ethics & Professional Responsibility for Certified Mediators” (effective July 1, 2011).

All memoranda, work products and other materials contained in the case files of the mediator are confidential. All communications related to the controversy being mediated, including screening, intake and scheduling a dispute resolution proceeding are confidential. The mediator may not be compelled to appear or to give testimony in any judicial, regulatory or administrative proceeding regarding the mediation and no documents or materials belonging to or in the custody of the mediator may be subpoenaed or in any other way sought to be used in any judicial, regulatory or administrative proceeding.
